Welcome to Gopi Bahu. These Terms of Service govern your access to and use of our website. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility & Account Registration

  • By using the Services, you represent that you are the age of majority in your state or country of residence. If you are under the age of majority, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

  • You may need an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.

2. Use of the Website & Services

  • You agree to use the Services only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.

  • You must not upload, transmit, or otherwise distribute any malicious code, viruses, or harmful programs.

  • We may suspend or terminate access to the Services for any conduct that, in our sole discretion, violates these Terms or is otherwise harmful to the Services or users.

3. Product Information & Jewellery‑Specific Disclosures

  • We strive to display product images, descriptions, prices, weights, sizes, and colors as accurately as possible. Actual colors and details may vary based on device settings and natural variations in gemstones and handcrafted items.

  • Metal purity, gemstone characteristics, and weights may exhibit minor tolerances due to manufacturing processes. Where applicable, products are supplied with BIS hallmarking or certifications from recognized laboratories. Availability of certificates may vary by product.

  • Certain customized, engraved, or made‑to‑order items may be non‑returnable. See our Returns & Exchanges Policy for details.

4. Orders, Acceptance & Cancellations

  • Your order is an offer to purchase. We may accept or decline any order at our sole discretion, including after order confirmation, subject to a full refund where we have already received payment.

  • We may cancel or limit quantities per person, household, account, payment method, billing/shipping address, or orders that, in our judgment, appear to be placed by resellers or distributors.

  • We may contact you for verification or additional information before accepting an order.

5. Pricing, Taxes, Promotions & Errors

  • Prices are subject to change without prior notice. Applicable taxes, duties, and shipping charges are additional unless otherwise stated.

  • In the event of an error in pricing, description, availability, or other information, we may cancel or refuse orders affected by such errors, even after order confirmation. If payment has been captured, we will issue a refund.

  • Promotional codes, vouchers, and offers are subject to their specific terms and may not be combined unless expressly permitted.

6. Shipping, Delivery & Risk of Loss

  • Shipping options, timelines, and fees are described at checkout or in our Shipping Policy. Delivery times are estimates only and may be affected by carrier delays or events beyond our control.

  • Title and risk of loss pass to you upon our delivery of the order to the carrier, except where applicable law provides otherwise.

  • For international shipments (if offered), you are responsible for any import duties, customs fees, and local taxes.

7. Returns, Exchanges & Refunds

  • Our Returns & Exchanges Policy explains eligibility, timelines, and procedures. Some items (e.g., customized or personalized pieces) may be ineligible for return or exchange.

  • Refunds, where applicable, will be processed to the original payment method, subject to our inspection and policy terms.

8. Payment; Billing & Account Information

  • We accept the payment methods shown at checkout. Payments are processed by third‑party payment processors, and we do not store full card details.

  • You agree to provide current, complete, and accurate purchase and account information, and to promptly update such information to enable us to complete your transactions and contact you as needed.

  • We reserve the right to refuse or cancel orders and to update, correct, or cancel transactions where fraud, unauthorized or illegal activity, or errors are suspected.

9. Optional Third‑Party Tools & Integrations

  • We may provide access to third‑party tools or services on an "as‑is" and "as‑available" basis without warranties. Your use of such tools is at your own risk and subject to the terms of the relevant third‑party providers.

  • Future features or new services added to the website will also be subject to these Terms.

10. Third‑Party Links & Content

  • The Services may contain links to third‑party websites or content. We are not responsible for examining or evaluating such content and do not warrant or endorse it. Your dealings with third parties are solely between you and the third party.

11. User Content: Reviews, Photos & Submissions

  • If you submit reviews, photos, ideas, proposals, you grant Gopi Bahu a worldwide, royalty‑free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.

  • We may monitor, edit, or remove User Content at our discretion but are not obligated to do so.

  • You are solely responsible for your User Content and represent that it does not infringe any third‑party rights, is not unlawful, defamatory, obscene, or harmful, and does not contain malware.

12. Intellectual Property & License to Use the Site

  • All content on the Services—including text, graphics, logos, images, product designs, icons, software, and trademarks—is owned by or licensed to Gopi Bahu and is protected by applicable intellectual property laws.

  • We grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services for personal, non‑commercial use.

  • You may not reproduce, duplicate, copy, sell, resell, exploit, or create derivative works from any portion of the Services without our prior written permission.

You agree not to use the Services:

  6. To collect or track others’ personal information without authorization;

  7. For spamming, phishing, pharming, pretexting, scraping, or crawling;

  8. To circumvent security features or access the Services by any means other than our publicly supported interfaces;

  9. For any obscene or immoral purpose; or

  10. To resell, redistribute, or commercially exploit the Services without authorization.

14. Warranty Disclaimer

  • The products are provided on an "as‑is" and "as‑available" basis without warranties of any kind, express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, or non‑infringement.

  • We do not warrant that the Services will be uninterrupted, timely, secure, error‑free, or that defects will be corrected.

15. Limitation of Liability

  • To the fullest extent permitted by law, Gopi Bahu, its affiliates, officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, revenue, or data, arising out of or related to your use of the Services or products, even if advised of the possibility of such damages.

  • Our total liability for any claim arising out of or relating to the Services or products shall not exceed the amount you paid to us for the product or service giving rise to the claim, or INR 10,000, whichever is lower, unless a different amount is mandated by applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Gopi Bahu and its affiliates, officers, directors, employees, agents, licensors, and service providers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your: (a) use of the Services; (b) violation of these Terms; (c) User Content; or (d) violation of any rights of a third party or applicable law.

17. Termination

  • We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

  • Upon termination, your right to use the Services will cease immediately, but sections that, by their nature, should survive (including payment obligations, IP rights, warranty disclaimers, limitations of liability, and indemnities) will survive termination.

18. Governing Law & Dispute Resolution (India)

  • These Terms are governed by the laws of India, without regard to conflict of law principles.

  • Subject to the arbitration clause below, the courts at Gurgaon, Haryana, India, shall have exclusive jurisdiction.

  • Arbitration. Any dispute arising out of or in connection with these Terms or the Services shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Gurgaon, Haryana, India. The proceedings shall be conducted in English by a sole arbitrator appointed in accordance with the Act. The arbitral award shall be final and binding on the parties.

19. Changes to the Services & to these Terms

  • We may modify or discontinue any part of the Services at any time without notice.

  • We may update these Terms from time to time by posting the revised version on the website and updating the Effective Date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

20. Personal Information & Privacy

  • Your submission of personal information through the Services is governed by our Privacy Policy. Please review it to understand our practices.

21. Electronic Communications & Notices

  • By using the Services, you consent to receive communications from us electronically (e.g., email, SMS, WhatsApp, in‑app messages). You agree that all notices, disclosures, agreements, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.

  • Legal notices to us must be sent to the address in Section 25.

22. Force Majeure

  • We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, pandemic/epidemic, utility failures, or internet outages.

23. Severability & Waiver

  • If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be deemed severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

  • Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

24. Entire Agreement

  • These Terms, together with the Privacy Policy and any policies or terms referenced herein, constitute the entire agreement between you and Gopi Bahu regarding the Services and supersede any prior agreements or communications

  • Acceptance. By accessing, browsing, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
